However, on March 8, 2023 the Chinese ambassador to the Netherlands, Tan Jian, officially submitted China\u2019s instrument of accession to the Hague Convention (<a href=\"https:\/\/www.china-briefing.com\/news\/china-joins-apostille-convention\/?utm\" target=\"_blank\" rel=\"noopener\">China Briefing<\/a>) of 5 October 1961.\u00a0<\/p><p>This has significantly simplified the process for getting documents authenticated for China. Below we explain how this process works in detail.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8e6ad2f elementor-widget elementor-widget-text-editor\" data-id=\"8e6ad2f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h2>What does the Apostille Convention Do?<\/h2><p>The objective of the Apostille Convention is to simplify the authentication of public documents for use abroad. Where the Apostille Convention applies, it abolishes the traditional and lengthy legalization process, replacing it with a single formality where an authentication certificate is issued by an appointed Competent Authority in the State where a public document was executed, and such a certificate is called an Apostille.<\/p><p>The Apostille Convention applies if and when all of the following conditions are fulfilled:<\/p><ul><li>The State in which the document was issued and the State in which the document is used are both party to the Apostille Convention;<\/li><li>The law of the State in which the document was issued considers it to be a \u2018public document\u2019; and<\/li><li>The State in which the document is to be used requires an Apostille in order to recognize it as a foreign public document.<\/li><\/ul><p>Each Contracting State is required to designate one or more authorities that are competent to issue Apostilles and each State is free to determine the identity and quantity of the competent authorities.<\/p><p>In most States a public document may be apostilled directly by a Competent Authority but in certain States the public documents may first need to be certified by one or more separate authorities (e.g. a professional or regional authentication body).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-570f68b elementor-widget elementor-widget-text-editor\" data-id=\"570f68b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h2>What Documents Can Be Authenticated via the Apostille Convention?<\/h2><p>The Apostille Convention only applies to \u2018public documents\u2019 and whether or not a document is considered a public document is determined by the law of the State in which the document was executed. In general, the Apostille Convention deems the following documents to be public documents:<\/p><ol><li>Documents emanating from an authority or an official connected with a court or tribunal, including those emanating from a public prosecutor, a clerk of a court or a process-server;<\/li><li>Administrative documents;<\/li><li>Notarial acts; and<\/li><li>Official certificates which are placed on documents by persons in their private capacity, such as certificates recording the registration of a document or the fact that it was in existence on a certain date and official and notarial authentications of signatures.<\/li><\/ol><p>As of 2026, China allows <strong data-start=\"454\" data-end=\"506\">civil, corporate, academic, and notarial records<\/strong> such as birth, marriage, or death certificates; court judgments; powers of attorney; company incorporation documents; business licenses; and notarized translations or contracts to be authenticated in this way. Once the Chinese notary or designated authority issues the apostille, the document is considered legally valid in all other Hague Convention member states without further embassy legalization.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7ec6c73 elementor-widget elementor-widget-text-editor\" data-id=\"7ec6c73\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h2>How to Notarize Documents for China?<\/h2><p>The Apostille Convention greatly simplifies the process to authenticate documents for China, as it significantly reduces time and costs to complete the authentication process.
